Yellowstone Landscape, Inc., and our subsidiaries and affiliates (collectively “Yellowstone Landscape,” “we,” or “us”) are committed to protecting your privacy. This Privacy Policy (the “Policy”) describes how we collect, store, process, and share your personal data. This Policy applies to the personal data collected by Yellowstone Landscape when you interact with us in an individual or household capacity via our website or through other channels, and when you use our content and services. It also describes your choices and rights with respect to your personal data where provided by applicable law. By submitting your personal data, you agree to the terms of the Policy, and you expressly consent to the processing of your personal data according to the Policy. 

This Policy also provides additional information required under the comprehensive state privacy laws, including the California Consumer Privacy Act, as amended by the California Privacy Rights Act (the “CCPA”) and the Texas Data Privacy and Security Act (the “TDPSA”), about our collection, use and disclosure of the information of California residents, along with other required information such as rights that may be available to California residents.

General Privacy Information

“Personal data” means any information that is linked or reasonably linkable to an identified or identifiable individual. De-identified or publicly available information is not personal data.

“Process” or “processing” means any operation or set of operations performed, whether by manual or automated means, on personal data or sets of personal data, including the collection, use, storage, disclosure, analysis, deletion, or modification of personal data.

“Sell,” “selling,” “sale,” or “sold,” means the sharing, disclosure, or transfer of personal data to a third party for monetary or other valuable consideration, or as otherwise defined under applicable privacy law, including the CCPA. These terms do not include the disclosure of personal data to our affiliates, to our processors, to third parties to provide a product or service you request, or in a merger or acquisition of our business or assets. The terms also exclude the disclosure of information that you have intentionally made available to the general public through mass media.

The Personal Data We Collect

Depending on your interactions with us, we may not have processed each of these categories of personal data about you. However, in the past twelve months, we may have processed the following categories of personal data about you:

Information You Provide to Us

  • Identifiers, such as email address, first and last name, and physical address.
  • Financial information, such as bank account number, credit card number or debit card number, other financial information.
  • Internet Activity Data, described in further detail in the “Information We Collect Automatically When You Use the Website” section below under “Information Collected by Cookies and Other Tracking Technologies”.
  • Location information, like your approximate location or data that indicates your approximate location, such as your IP address.
  • Sensitive information (as that term is defined under applicable privacy laws) such as government identifiers only when you choose to provide such information (e.g., by uploading documents containing such information through the website). We use such information only for lawful purposes in compliance with applicable laws and do not use such information to infer characteristics about individuals.
  • Other information you choose to provide when you interact with us.

Information We Collect Automatically When You Use the Website

When you access or use our website, the types of information we automatically collect about you may include:

  • Log Information: When you visit the website, our servers automatically record certain log file information, such as your Internet Protocol (“IP”) address and other information about your activities on the website.

We may also de-identify personal data by removing any details that identify you personally. If we do so, we will maintain and use the de-identified data without attempting to re-identify it. De-identified data will not be subject to this Policy and will be used to the extent permissible under applicable law.

In the preceding 12 months, we have not sold any personal data to third parties for profit. We have shared personal data for purposes of cross-context behavioral advertising. You may opt-out of the sharing of your personal data by updating your cookie preferences as described below in the “Cookies and Similar Technologies” section.

Who We Disclose Personal Data To
We may share the categories of personal data listed above in “The Personal Data We Collect” section to the following categories of entities:

  • To our affiliates;
  • To our processors, including our contractors and service providers who process personal data on our behalf and who support our continued provision of products and services and the website; and
  • To third parties such as regulatory authorities or other third parties in response to legal process or other legal reporting requirements; to potential buyers (and their agents and advisors) in connection with any proposed merger, acquisition, or any form of sale or transfer of some or all of our stock or assets (including in the event of a reorganization, dissolution, or liquidation); trade union representatives (if applicable); and other similar third parties where disclosure is required for an ordinary business purpose in connection with our provision of services.

We use various security technologies, policies, and procedures to help protect your personal data from accidental loss and unauthorized access, use, alteration or disclosure. All personal data is protected using appropriate physical, technical, and organizational measures. In addition, we take measures to limit access to personal data to those employees, agents, contractors, and other third parties that have a legitimate business need for such access. Although we use appropriate security measures, the transmission of information over the internet is never completely secure, and we cannot guarantee that your personal data will remain secure in all circumstances.

Retention of Personal Data

We keep personal data for as long as necessary to carry out the processing activities described in this Policy, including to provide and administer the website, provide you with customer service, answer your inquiries, resolve technical problems, comply with applicable laws, regulations, rules, and requests of relevant law enforcement and/or other governmental agencies, and to protect our, our employees’, and our business partners’ and clients’ rights, property, or safety and the rights, property and safety of others. We may retain personal data for a longer period of time if a longer retention period is required or permitted by applicable law, as well as our records retention requirements and policies. In specific circumstances, we may also retain your personal data for longer periods of time so that we have an accurate record of your dealings with us in the event of any complaints or challenges. We may also retain cached or archived copies of your information for a reasonable period of time.

Cookies and Similar Technologies 

As is common with modern websites, we collect information using automatic data collection technologies, like cookies and tracking pixels. Google Analytics uses cookies to help us analyze how visitors use our website. The information generated by the cookies about your use of the website includes your IP address. If you so choose, you may be able to opt out by turning off cookies in the preferences settings on your browser. Children’s Privacy

Our website is not intended for persons under the age of 13 and we do not knowingly collect personal data from visitors in this age group.

This website is intended for use only in the United States of America. We are based in the U.S. and the information we collect is governed by U.S. law. By accessing or using this website or otherwise providing information to us, you consent to the processing and transfer of information in and to the U.S. and other countries, where you may not have the same rights as you do under local law. Where this is the case, we will take appropriate measures to protect information about you in accordance with the Policy.

We may provide links to other websites and services for your convenience. Those sites and services are not subject to this policy. The operators of the linked websites and services may have posted their own privacy policies that you should review to learn more about their privacy practices.

Unsubscribing and Controlling Your Personal Data

You may unsubscribe from our marketing communications by clicking on the "unsubscribe" link located at the bottom of our e-mails. Your web browser may have a “Do Not Track” feature that is intended to automatically inform websites you visit not to track your online activities. Our website does not process or respond to these “Do Not Track” signals from your browser.

In some jurisdictions, applicable law may entitle you to certain rights regarding your personal data. The rights available to you depend on our reason for processing your personal data and the requirements of applicable law (i.e., your rights will vary depending on where you are located; for example, the TDPSA and CCPA provide Texas and California residents, respectively, with certain rights regarding their personal data).

  • Correction: The right to request that we correct your personal data if that information is inaccurate, taking into account the nature of the personal data and the purposes of our processing of the personal data.

  • Portability: The right to obtain a copy of your personal data in a portable and, to the extent technically feasible, readily useable format that allows you to easily transmit the data to another controller, subject to certain exceptions.
  • Non-Discrimination: The right to not be discriminated against for exercising your privacy rights.
  • Opt-out of Sale and Targeted Advertising: The right to opt-out of the sale or sharing of your personal data for cross-context behavioral advertising. While we do not sell personal information for money, like many companies, we use services that help deliver interest-based ads to you. Our use of some of these services may be classified under California law as “selling” or “sharing” your personal information with the advertising partners that provide the services. Please note that many of the above rights are subject to exceptions and limitations. Your rights and our responses will vary based on the circumstances of the request. If you choose to assert any of these rights under applicable law, we will respond within the time period prescribed by such law.

How to Submit a Request

Verifying Requests
To help protect the privacy of data subjects requesting to exercise their privacy rights (“Requestors”) and maintain security, we will take commercially reasonable steps to verify the Requestor’s identity before granting access to their personal data or complying with their request. For example, we may require the Requestor sign a declaration under penalty of perjury that they are the individual whose personal data is the subject of the request and provide appropriate proof of identity. For requests about a child under the age of 13, we accept requests for information regarding minors under the age of 13 if we can determine that such requests were submitted by a parent or guardian.

In certain states, like California, a person authorized to act on your behalf may make a verifiable request related to your Personal Information. Authorized agents may initiate a request on behalf of a data subject using the same methods described above. Authorized agents will be required to provide proof of their authorization, and we may also require that the data subject directly verify their identity and the authority of the authorized agent. Data subjects may also provide us with a signed and dated power of attorney naming the authorized agent as their representative.

Responding to Requests
Generally, we will respond to a request within the time period prescribed by applicable law. If we need more time to respond, we will provide the Requestor with notice and an explanation of the reason we need more time to respond. We may deny the request if we cannot verify the Requestor’s identity using commercially reasonable means or if we are legally permitted to deny the request.

If we deny the request we will, within the time period prescribed by applicable law, explain the basis for our denial. To the extent permitted by applicable law, we may decline or charge a reasonable fee to comply with a request if the request is manifestly unfounded, excessive, or repetitive. Additional Notice for California Residents (California Shine the Light)

If you are a California resident, California Civil Code Section 1798.83 permits you to request information about our practices related to the disclosure of your personal data to certain third parties for their direct marketing purposes. You may be able to opt-out of our sharing of your personal data with unaffiliated third parties for the third parties' direct marketing purposes in certain circumstances. Updates to This Policy
We may update this Policy to reflect changes in our privacy practices at any time and without prior notice to you. When we make material changes to this Privacy Policy, we will update this web page and change the Effective Date listed above.
